Phytosanitary certificate

The exchanges of plants and products of plant origin in the European Union and between it and third countries are governed by EU rules and international agreements which have the aim of reducing phytosanitary risks, represented by the introduction and spread of harmful organisms for plants.

European Union

European Union Regulation (EU) 2016/2031 of the European Parliament and of the Council, relating to protective measures against organisms harmful to plants, entered into force on 14 December 2019.
Article 65 of this Regulation introduces the Official Register of Professional Operators (in Italy the RUOP), to which must register professional operators (OP) who introduce or move plants, plant products and other objects within the European Union for which a phytosanitary certificate or a plant passport is required respectively. The registration to the RUOP is unique at national level and must be done at the Phytosanitary Service of the Region where the exporter has its registered office.
All Italian companies that sell their production of succulent plants are attributable to this category, with the exception of those that supply exclusively and directly to end users (therefore to natural persons who do not carry out the resale of these products) small quantities of plants and seeds, i.e. using means other than selling through distance contracts (such as e-commerce sites, facebook, instagram and other tools on the internet, fax, telephone etc. ...).

Third countries (non-EU)

Plants entering and leaving the Community must be accompanied by an official document (respectively Authorization for import and Phytosanitary Certificate for export) issued by the Phytosanitary Service competent for the territory, which declares the absence of harmful organisms subject to regulation. All of this by applying the prophylaxis rules contained in the International Plant Protection Convention and the Phytosanitary Directives issued by the European Union.

Also in this case, Regulation (EU) 2016/2031 introduces new rules and new requirements, providing for the obligation to be registered in the Official Register of Professional Operators (RUOP) also for POs that require the issue of certificates for export, re-export and pre-export.

Export

Plants and plant products destined for countries outside the European Union, on the basis of the regulations of the individual importing countries, must be accompanied by a phytosanitary certificate which certifies the absence of harmful organisms and issued by the inspectors of the regional Phytosanitary Service. It is an official document that certifies that the goods have been checked in compliance with the rules established by the importing country and is exempt from regulatory bodies. The certificate is mandatory for all those who need to export plant-based goods to those third countries whose phytosanitary regulations require it, both professional operators and ordinary citizens.

CITES

The production and sale of plants included in CITES annexes A and B (see the official list) is subject to regulation. Those who do not comply are subject to administrative sanctions and, in the most serious cases, penalties. The sanctioning rules are applied both in cases of infringement by companies and individuals.

Italian regulation

Italy has adopted its own CITES legislation which transposes what has already been defined in the community, but tightening the authorization policies. In particular, the purchase and subsequent resale (trade) of plants from artificial propagation can be legally implemented only by those (company or private) who hold the Loading and Unloading Register a sort of 'register of fees' on which to note purchases and sales, issued by the cites certification body.

As regards the simple possession of CITES plants, there is no legal obligation.

European regulation

Sale of plants and seeds • Within the European Union, the sale of plants collected in nature of species listed in CITES Annex A is prohibited, unless the specimens are accompanied by appropriate documentation attesting their legal detention in captivity. The sale of plants and seeds of species included in Annex B and of plants included in Annex A of the Convention (provided that the plants have been artificially propagated by authorized structures) is free and is not subject to any obligation.

Authorized structures • Anyone (private or company) who wants to produce plants included in Annex A using seeds of their own production, or mother plants (in the case of cloning by cutting, grafting, etc.) is obliged to obtain appropriate authorization, accompanied by the list of species allowed species issued by the certification body of the country of residence.

Regulation of third countries (extra EU)

It is very important to inquire about the rules that affect the import of plants and seeds into your country. The shipment is carried out by us on the basis of your instructions. We do not take any responsibility if the goods are confiscated by your customs authorities due to missing or incorrect documentation for your. negligence.

Canada, China, Taiwan, USA: they require import permits. Please get all the necessary import documents before placing your order. We take no responsibility for plants confiscated by your authorities due to irregularities in the presentation of documents.


Mondocactus certifies

Plant passport and phytosanitary certificate


Mondocactus is a Professional Operator registered with the RUOP with the code IT-08-3812 and issues the passport for plants free of charge for every sale carried out within the European Union.

In case of export to third countries, Mondocactus issues the Phytosanitary Certificate issued by the inspectors of the Plant Health Service of the Emilia-Romagna Region at a cost of € 35 up to 100 kg of goods.

CITES

Mondocactus has obtained the recognition of a structure authorized for the artificial reproduction of plant species included in Annex A of REG (CE) n. 338/97, pursuant to article 56 REG (EC) no. 865/06, as per the opinion expressed by the CITES Scientific Commission during the 195th meeting of 11 July 2012. Mondocactus is a CITES company registered with the Ministry of the Environment with the code P-IT-1004.

With each sale Mondocactus issues a CITES declaration of conformity free of charge, which certifies that the plants were produced in compliance with all relevant legal provisions.

Upon request for export of artificial reproduction plants belonging to species included in CITES Annex A to countries outside the European Union, Mondocactus issues the CITES Certificate issued by the Management Authority at a cost of € 45. A single certification can include up to a maximum of three species, without any limit in the number of specimens (it costs the same amount if you want to import any number of plants, from one to three different species).

Upon request for export of artificially propagated plants belonging to species included in CITES Annex B to countries outside the European Union, Mondocactus issues the declaration of export suitability attached to the phytopathological certificate free of charge.
